2017 Bail Agent Of The Year
Even though you have been granted the option of bailing out of jail, it's not unusual for the court or bail bond agency to require you to adhere to a few pre-trial release conditions. Discover three of the most common ones placed on defendants to help you plan your life accordingly.
1. Travel Restrictions
Both the court and bail agency have a vested interest in making sure you show up to your trial dates. So, travel restrictions as a condition of release are fairly routine. These restrictions may include requiring you to get written approval to leave town, surrender your passport, or undergo ankle monitoring at home.
Several factors contribute to the type of travel restrictions placed on you, such as the charges, your criminal history, and your level of flight risk. Bail agencies will also look at whether you've missed court appointments or jumped bail before when deciding how to handle this aspect of your case.
As you can imagine, travel restrictions will have a significant impact on your mobility. In many cases, though, you may qualify for exceptions. At minimum, the court and bail agent will work with you if you have special circumstances, so don't be afraid to be upfront and honest about your needs.
2. Stipulations Related to Drugs and Alcohol
Cases where drugs and alcohol were a factor will often include conditions related to them. For instance, a person with multiple DUI offenses on their record may be required to have an ignition interlock installed in their vehicles or undergo substance abuse counseling and treatment.
Bail bond agencies may also institute conditions related to your drug and alcohol usage if they are concerned it will impact your ability to show up for your trial dates. You may be asked to stop using drugs and subjected to random testing to ensure you stay sober enough to manage your court case, for instance.
Sometimes, adhering to drug and alcohol restrictions can be challenging, especially if you're dealing with addiction issues. Don't be afraid to ask for assistance when you need it. Bail bond agents who've been in the industry for years have likely encountered these issues before and can point you to some resources that can help you stay on track, so check in with your agent when you feel yourself struggling.
3. Public Safety Conditions
Public safety is a top concern when deciding whether someone can bail out of jail. If a judge thinks it's too dangerous to let a defendant roam around free in the community, they will typically deny bail and keep them in custody until the trial ends.
Even if the court thinks it's safe enough to release you, the judge commonly places conditions that reduce the risk while you're free. For example, you likely will be ordered to give up—temporarily at least—any weapons you own. If you committed a crime against another person, the judge will typically tell you to not communicate with them in any way.
A bail bond agent may not necessarily place these types of conditions on you, but they will make note of them. Violating these conditions can result in the revocation or forfeiture of your bail by the court, which may cause the bail company to lose the money it put up as a guarantee for you. So, the agent may check in with you at regular intervals to ensure you're complying with the judge's orders.
Pre-trial conditions are a normal part of the bail bond process, and you can expect to have a few placed on you at your bail hearing. If you have questions about how these conditions impact your ability to get and stay out of jail, feel free to
