When you're arrested, you usually have the option to stay in jail or post bail to be released until your hearing. In most cases, you need to post money or collateral to be released on bail. Your Attorney May Get Your Bail Amount Lowered
Most common crimes come with pre-set bail amounts, and others may require a bond hearing for a judge to determine a fair dollar amount for your bail. Regardless, if your bail is too high, your attorney can file for a bail reduction hearing.
In most cases, your attorney will use the Eighth Amendment of the US Constitution, which prohibits excessive bail. They may do this by proving you aren't a risk to the community and you aren't a flight risk. They may also accuse the court of setting bail so high that it is actually a denial of bail because there is no way you can pay the bail.
Of course, courts don't have to lower bail just because you can't afford it, so your attorney will also need to show that you will be an upstanding citizen while you await your trial.
Bail Bonds Can Be Secured or Unsecured
As the name suggests, secured bail bonds are simply just that. Sometimes bail bondsman require collateral in addition to the 10% fee but in most cases just a qualified co-signer is all that you will need to provide to a bail bondsman. If a bail bondsman requires actual collateral as security to be held by the bondsman in this instance, the same as known as a secure bond. With a secured bail bond, you need to offer collateral (a car, property, cash, jewelry, etc.), which serves as a promise you will attend your hearing and security if you don't attend your hearing, in case the bail bond agent loses their bond money that they posted on your behalf. At the very least, they can sell your collateral to recoup their losses to the court.
With an unsecured bail bond, you don't need any collateral, which makes it a better choice if you don't own property or anything of value. Instead of collateral, these unsecured bail bonds are accepted by your bail bond agent as your written promise to appear in court. In most cases, these are only used for minor crimes. If someone has been accused of murder, they won’t qualify for an unsecured bond.
You May Need a Cosigner for Bail Bonds
If you do request an unsecured bail bond, there is a greater chance you may need a cosigner for the bail bond. The sad truth is that bail bond agents don't know you or how trustworthy you are. For this reason, they'll want someone who knows you and who will therefore stand by you with their promise that you will attend all of your hearings.
If you do decide to run, the bail bond agent will go after the cosigner for the money that you owe for forfeiting the bail bonds. If your cosigner doesn't think you will attend your hearing, they can easily contact the bail bond agent to request to be withdrawn from the bond. This will result in you being taken back to jail, which is commonly known as off-bonding.
You Need to Be Prepared to Pay Your Bond Fees
As long as you attend all your hearings and follow all the rules set forth by the court, the bail bond agent will then be exonerated against any further liability, by the courts, which then means your co-signer is also exonerated from any further liability. Of course, to be paid for their services, the bail bond agent also charges you 10 percent of the total bail amount. This 10 percent is not reimbursed by the court or the bondsman, it is not refundable per Florida statute.
