A bail amount can seem fairly mystifying. The same crime can be committed by different people and come up with entirely different bail amounts. Some people may have bail requested, while others are simply released, and still, others are not allowed bail at all. Why?
What is Bail For?
First, it is important to note that bail is not considered to be a punishment. Bail is purely designed to be a guarantee that an individual will show up to court. Otherwise, an individual might not show up hoping that the issue will not be pursued (for minor crimes) or they may run (for major crimes).

How Is Bail Determined?
Bail is determined by a lot of factors. If it is a minor crime, the judge may set bail at an amount that is not very high but that the individual would still find it unpleasant to lose. Because of that, the judge will also consider the individual's own net worth and assets when setting bail.
If it is a more significant crime, the judge will be focused on setting the bail to an amount that the individual simply cannot afford to lose. Again, the individual's net worth and assets are going to be considered and consequently will play a major factor.
But that is not all. Judges also consider whether the person is likely to not show up to court. People who have had past court dates that they missed or are habitually in court will usually have higher bail amounts than those who are first-time offenders or who reliably make their court dates.
People who have a lot of ties to their local community also often get low bail because it is not likely they would give up their ties to their community and family to avoid court.
Can You Request a Lower Bail?
It is absolutely possible to request that the amount of your bail is reviewed. You or your lawyer can make a case to a judge that the amount of bail would be unfairly significant to you or impossible to pay.
But keep in mind that these types of requests will usually require that you spend more time in jail. You will need to schedule an appeal for your bail and go through it, and at the end of this, your bail amount may not have been decreased at all.
What If You Can't Afford the Bail?
Many people will find that they simply can't afford bail. Though you will get it back later, you need to have it in liquid cash. You also are not guaranteed a time frame; there could be numerous court dates over which the bail will be kept, and you will be out that cash.
In this situation, you may need to find a bail bonds agent. A bail bonds company will be able to write you a bail bond that is about 10 percent of the cost of bail itself. Though this bond will not be refundable (and you will still owe the full amount if you do not show up to court), you will only need to pay that amount.
